Term's of Service (TOS)

Section A

By commissioning lowlifefawn ("Me", "Cody", "I", "My", "Artist") you ("Client", "You") agree to the following Term's. These Term's apply to all menu commissions, adoptable's, and custom designs.



This is Section A, once you finish reading this, press the "Next" button to move onto Section B.



This segment covers Acceptance of Work, Communication, Revisions, Payment, Usage Rights & Licensing, Watermark Policy, scope, and turn around time (TAT).

A1: Acceptance of Work

* A commission is fully accepted when turn around time is stated or when a deadline is set.

* I reserve the rights to decline, refund, or terminate a commission at any point up until the final piece is delivered.

* If a commission is declined or terminated before work has started, you receive a full refund.

* If terminated mid-process, refund eligibility depends on progress stage.

A2: Communication (Mandatory)

Communication is strictly mandatory during the commission process. If communication is broken at any point, or if I feel communication is not working, it may result in a termination of your commission.

What I expect from our communication:



* A thorough, complete, reference and breakdown from the Client of what they want from the commission, including photos and clarification's for what you like from each photo.

* Confirmation throughout the sketch process to make sure everything is correct and exactly how you want it.

* Payment and price confirmation from both parties. This keeps both Client and Artist safe and keeps documentation centralized.

* Failure to respond when messaged to confirm the work is set to move onto the next stage will result in the progress being paused until you respond.

* If you fail to respond within 7 days of a progress update, your commission will be terminated.

* The Client is responsible for providing accurate and correct reference's, spellings, design details, and specifications prior to the sketch phase. Big revisions (I.E: Pose changes) may require a paid revision.



Failed or broken communication may look like:



* Failure to respond within 7 day timeframe

* Not giving clear answers to questions or clear revision requests

* Dry responses when asking if the piece is set to move forward (I.E: "Yeah its ok", "Ok")



If a commission is started via TikTok or Twitter/X DM's it is required that the conversation is moved to either Instagram or Discord. This is purely for my own convenience.

A3: Revisions

What is a revision?

A revision is a change made to the artwork during the drawing phases. This can be pose changes, the changing of a detail within the work, color changes, or lighting changes.



Note: A batch of revisions (I.E: "I would like (pose of hand) to be changed to (new pose) and I would like the colors to be changed to a warmer shades") counts as ONE revision. If you ask for any more after that, or in a separate message, it will count as another revision.



Lowlifefawn/Cody only allows a certain number of revisions per drawing stage. If you surpass this number of revisions, you will be required to pay a revision fee.



Sketch Phase

I allow as many revisions needed during the sketching phase. No fee's will be added for any revisions at this stage.



Line Art Phase

I allow as many revisions needed during the sketching phase. No fee's will be added for any revisions at this stage.



Flat Colors Phase

I only allow 5 revisions during this stage. I will not accept pose changes or item changes during this phase. Changes not included in this list will also require a fee.



Basic Render Phase

I only allow 2 revisions during this stage. Only select color changes, shading adjustments, and lighting changes are allowed. Changes not included in this list will also require a fee.



Full Render Phase

I no longer accept revisions during this stage as the piece is/is almost completed. Any revisions or changes will require a fee.

A4: Payment

* Payment is required to be sent before the commission is started, or after the sketch is complete and you are happy with it.

* Rushed work requires a non refundable rush fee.

* Chargebacks or refund's past the rendering phase is prohibited and are treated as a contract violation.



I *ONLY* take Robux & discord nitro/decorations. I am unable to take cash via an app like PayPal, CashApp, or Apple Pay. If you are unable to pay via either 2 options, please find somebody else to commission.

A5: Digital Use Right's (Personal Use)

Personal Use includes:



* Social Media profile pictures

* Discord/Twitter(X) banners

* Discord avatars

* Non-monetized blogs

* Personal server icons

* Private prints (I.E: Personal posters, pins, bag charms)

* Just having your art piece!



Personal Use does NOT include:



* Use on any monetized platform without commercial use license. (+20%)

A6: Commercial Use Right's (Monetized Use)

Lowlifefawn/Cody is not liable for indirect, incidental, or consequential damages arising from the use or inability to use the art work beyond the amount paid for the commission.



A6.1: Commercial License Policy (+20%)



Any monetized, revenue-generating, promotional, resale, or business use requires a Commercial License Add-On.

A Commercial License Add-On = +20% of your commissions full price.



A6.2: Commercial License Payment Method



The Artist will give you the fee in robux, or roughly find what discord decorations would add up for the additional fee.

A refusal to pay the Commercial Use Fee may result in a blacklist from commissioning lowlifefawn again in the future.



A6.3: What counts as Commercial Use?



* Twitch Affiliate or Partnered channels

* YouTube channels with monetization enabled

* Tiktok accounts earning Creator Fund / band deals

* Patreon / Ko-Fi paid tiers

* Paid Discord servers or gated communities

* Twitch sub badge / emote usage

* Stream overlays

* VTuber branding

* Channel panels

* Logo's

* Marketing Graphics

* Brand identity assets

* Merchandise (I.E: Stickers, Clothing graphics, prints, digital packs)

* Merchandise packaging

* Book Covers

* Album Covers

* Promotional Thumbnails

* Business websites

* Blog sites running ad's

* Using artwork to promote paid commissions/services



If money is being name directly or indirectly from the artwork's use, it is commercial.

If you are still unsure if it would count, feel free to ask before the sketch is started!



A6.4: Creator / Steamer Clause



If artwork becomes apart of:



* A visual brand identity

* A recurring streaming persona

* A monetized content series

* Channel graphics package



It must be upgraded to commercial use. If you later wish monetize the personal use commission, you must upgrade your license before monetization begins.



A6.5: What the Commercial License includes



* A digital Certificate of Commercial Approval

* A written document verifying Commercial License Term's

* Final, high definition, unwatermarked files



Commercial License grants:



* Non-exclusive usage rights

* Monetized digital usage

* Marketing use

* Print production rights



Commercial License does NOT grant:



* Copyright ownership

* Resale of raw files

* NFT minting, strictly prohibited. If caught this will get you blacklisted.

* AI dataset inclusion, strictly prohibited. If caught this will get you blacklisted.

* Derivative Licensing



A full copyright buyout required a separate contract. This includes significantly higher rates.

Copyright is NOT transferred unless explicitly agreed to in a separate buyout contract. This is a usage license, NOT a copyright transfer.

A7: Watermark Policy

All drafts, progress reports, and update photos will be watermarked.

All finished pieces remain watermarked until a Commercial License is paid for.

Removing the watermark is a violation of these Term's and can lead to a potential blacklist from commissioning again.

A8: Scope Expectations

My scope is the limitations and expectations my art can be held to for both Client and Artist. I hope that this makes your purchase feel more secure and make you have a better feel of my art and abilities.



What to Expect:



* Some anatomical proportions may be stylized to fit my style more accurately

* Facial proportions (I.E: Eyes, mouth, nose) may be changed to fit my style more accurately

* Rendering may not be consistent between works, it can range from softly blended to a more painterly style.

* Line work may vary from piece to piece. Ranging from very sketchy and loose to very clean and refined.



I Do Not Guarantee:



* Art styles accurate to you reference photos

* Exact realism

* 100% Accurate representation of game characters

* Styles accurate to TV shows

* Mimicking an AI "art tyle"

A9.1: Turn Around Time (TAT) & Deadline's (Anthro)

Turn Around Time (TAT) is the timeframe your work will be estimated to be finished in, while a deadline is something you will set with me in DM's.



Deadline's are a date the work HAS to be done by. Possibly for a debut, an event, a convention, or a YouTube video. Depending on date, a rush fee may be required.



TAT Estimations 1 - Headshot's - Antho:



* Sketch: 1 hour - 6 hours till full completion depending on character complexity

* Line Art: 3 hours - 6 hours till full completion depending on character complexity and line art style

* Flat color: 7 hours - 1 day till full completion depending on character complexity

* Basic render: 1 day - 3 days till full completion depending on character complexity

* Full render: 5 days - 1 week till full completion depending on character complexity



TAT Estimations 2 - Half Body - Antho:



* Sketch: 2 hours - 6 hours till full completion depending on character complexity

* Line Art: 3 hours - 6 hours till full completion depending on character complexity and line art style

* Flat Color: 7 hours - 1 day till full completion depending on character complexity

* Basic Render: 1 day - 3 days till full completion depending on character complexity

* Full Render: 5 days - 1 week till full completion depending on character complexity

* Front Only: 1 day - 3 days till full completion depending on character complexity

TAT Estimations 6 - Chibi's - Anthro



* Sketch: 1 hour - 3 hours till full completion depending on character complexity

* Line Art: 2 hours - 6 hours till full completion depending on character complexity and line art style

* Flat Color: 3 hours - 6 hours till full completion depending on character complexity

* Basic Render: 4 hours - 7 hours till full completion depending on character complexity
